Tiwala Loan
Terms & Conditions
These Terms & Conditions (“Terms”) govern access to and use of the Tiwala Loan mobile app and related services (“App” or “Service”), operated by TIWALA LENDING INVESTOR, INC. (“Company”, “we”, “us”). Please read them with the Privacy Policy.
The App is still being built and is not available to download. Browsing this website does not create an account or a loan. These Terms bind you if you download, register, or use the App after it is released. If you do not agree, do not register or apply.
A specific loan is governed by the disclosure statement and loan agreement shown in the App for that loan. If those documents differ from these Terms on amount, price, or schedule, the loan documents control for that loan.
1. Acceptance
Creating an account or sending an application means you have read and accepted these Terms, the Privacy Policy, and any disclosure statement or promissory note presented before you accept a loan. Together, they are the agreement between you and the Company for the Service.
2. Who may apply
To use the Service once it is released, you must:
- Be a Filipino citizen residing in the Philippines
- Be at least twenty-one (21) years old and not older than sixty (60) at the time you apply
- Hold a valid government-issued identification document
- Have an active Philippine mobile number, and a bank account or e-wallet in your own name, such as GCash or Maya
- Have the legal capacity to enter a binding contract
The Service is for personal borrowing. It is not offered to companies as a business credit line, and it is not offered to anyone under 18. We may check eligibility and may approve or decline any application.
3. Your account
You must give information that is accurate, current, and complete, and you must keep it up to date. You are responsible for your sign-in details and for activity under your account.
- You may keep only one account, and you may not apply with another person’s identity
- Tell us promptly if you believe someone else has used your account
- We are not responsible for loss caused by your failure to protect your sign-in details
4. Applications
Sending an application does not mean it will be approved. Applications are subject to identity checks, credit assessment, and risk review. We may ask for more documents. No loan exists until you have accepted that loan’s disclosure statement in the App.
This website does not publish a maximum amount, a term, an interest rate, or a release time. Those figures, if a loan is offered, are calculated for you and shown in the App before you accept. The App is not yet released, so loan requests are not accepted on this website.
5. Interest, fees, and other charges
Republic Act No. 3765, the Truth in Lending Act, requires the cost of a loan to be disclosed before you commit. Before you accept, the App will show the interest, any processing or service fee, any penalty that can apply, the total amount payable, the payment schedule, and the effective interest. There is no charge that is kept off that screen.
You may pay a loan early. Early payment does not add a prepayment penalty.
6. Repayment
If you accept a loan, you agree to pay the amount due, including interest and fees that were disclosed, on or before the dates in your disclosure statement. Payments are made through the channels shown in the App, which may include bank transfer, e-wallet, or an accredited payment partner.
- You are responsible for having enough funds and for paying on time
- Payments are applied in the order stated in your loan agreement, commonly fees, then interest, then principal
- Keep proof of payment until the App shows the loan as fully paid
7. Late payment
If an amount is not paid when due, the loan may be past due or in default. Where your loan agreement discloses them, late charges or default interest may apply. Your repayment record may be reported to credit bureaus, including the Credit Information Corporation, and that report can affect later applications. We may also pause your ability to request another loan and may pursue collection as described in Section 8.
Borrow only what you can repay. Late or missed payment can affect your credit standing and future access to credit.
8. Collection
Collection follows SEC Memorandum Circular No. 18, Series of 2019 and Republic Act No. 11765. If an amount is overdue:
- We will not contact people in your phone’s contact list to collect the debt
- We will not use threats, harassment, profanity, or abusive or misleading messages
- We will not publish your debt or shame you in public
- Contact will come from identified staff, at reasonable hours
- You may report abusive collection to the Securities and Exchange Commission
9. Conduct that is not allowed
You agree that you will not:
- Give false, misleading, or fraudulent information or documents
- Use the App for an unlawful purpose, including fraud or money laundering
- Use another person’s identity, ID, or financial account
- Try to break into, disrupt, or reverse engineer the App or its security
- Use bots or other automated tools to access the Service
A breach may lead to suspension or closure of the account and may have civil or criminal consequences.
10. Privacy
The App processes personal data under Republic Act No. 10173 and the Privacy Policy. The Privacy Policy is part of these Terms. Using the Service after release means you accept that processing, as the Policy describes it.
11. Intellectual property
The App, its software, text, trademarks, and the Tiwala Loan name and logo are owned by the Company or used under license. You receive a limited, non-exclusive, non-transferable, revocable right to use the App for personal loan requests. You may not copy, change, sell, or build on those materials without prior written consent.
12. Availability and liability
The App is provided as available. To the extent the law allows, we do not promise uninterrupted access or that the App will meet a purpose we have not stated. To the extent the law allows, the Company is not liable for indirect or consequential loss, or for loss caused by events outside our reasonable control. These Terms do not remove any liability that Philippine law does not allow us to exclude.
13. Suspension and ending access
We may suspend or close access, with or without notice, if you breach these Terms, give false information, misuse the Service, or if the law requires it. Ending access does not cancel a loan you still owe. You may stop using the App at any time and remain responsible for any unpaid balance until it is settled.
14. Law and disputes
These Terms are governed by the laws of the Republic of the Philippines. A dispute should first go through the Company’s complaint handling under Republic Act No. 11765. If it is not resolved that way, it may be brought to the proper regulator, including the Securities and Exchange Commission where that agency has authority, or to the proper courts of the Philippines.
15. Changes to these Terms
We may update these Terms when the Service or the law changes. A material change will be posted on this page and, once the App is live, notified in the App or by email at least seven (7) days before it takes effect. Using the App after that date means you accept the updated Terms.
16. Contact
Questions about these Terms can be sent through the contact channel published on this website and in the App before release. The Company’s telephone number, email, and office address will be added here at that time. Do not send an application or identity documents through this website while the App is still in development.
